{"id":48074,"date":"2026-02-23T05:29:29","date_gmt":"2026-02-23T05:29:29","guid":{"rendered":"https:\/\/isafespend.com\/?p=48074"},"modified":"2026-02-23T05:29:31","modified_gmt":"2026-02-23T05:29:31","slug":"social-security-fairness-act-unfair-taxes-and-the-bill-that-aims-to-fix-it","status":"publish","type":"post","link":"https:\/\/isafespend.com\/?p=48074","title":{"rendered":"Social Security Fairness Act: Unfair Taxes and the Bill That Aims to Fix It"},"content":{"rendered":"<div id=\"body-575189\">\n<p>The Social Security Fairness Act signed at the beginning of 2025 is now unfair, at least when it comes to taxes, according to some representatives in Congress.<\/p>\n<p>The\u00a0Social Security Fairness Act eliminated the\u00a0Windfall Elimination Provision (WEP)\u00a0and the\u00a0Government Pension Offset (GPO), which reduced Social Security benefits for about 3.2 million public-sector retirees who also receive pension income. The law\u2019s\u00a0effective date was retroactive\u00a0to January 2024, so many beneficiaries received last year a one-time retroactive payment that may have amounted to thousands of dollars and higher monthly benefits, starting in 2025.<\/p>\n<p>Those income spikes last year likely triggered more taxes for many people, experts said. To help address the potential tax bomb, Rep.\u00a0Lance Gooden, R-Texas, introduced earlier in February the bipartisan No Tax on Restored Benefits Act to amend the tax code to exclude retroactive Social Security payments tied specifically to the repeal of WEP and GPO from federal taxable income.<\/p>\n<p>\u201cFor hundreds of thousands of Americans, the bipartisan Social Security Fairness Act was truly transformative, ensuring they received the benefits they deserved,\u201d said Rep. Chellie Pingree, D-Maine, cosponsor of the bill, in a news release. \u201cBut it was never intended to saddle widows, low-income seniors, and dedicated public servants with an unexpected tax bill.\u201d<\/p>\n<h2>How much are the extra taxes?<\/h2>\n<p>How much of people\u2019s Social Security benefits will get taxed depends on the total amount of their income, including\u00a0tax-exempt interest like from a municipal bond, plus one-half of their Social Security benefits for the taxable year.<\/p>\n<p>Up to 85% of your Social Security benefits can be taxed\u00a0depending on how much more that combined income is over the base amount for your filing status.<\/p>\n<p>The base amounts based on filing status are:<\/p>\n<ul>\n<li>$25,000 if you\u2019re single, head of household, or qualifying surviving spouse<\/li>\n<li>$25,000 if you\u2019re married filing separately and lived apart from your spouse for the entire year<\/li>\n<li>$32,000 if you\u2019re married filing jointly<\/li>\n<li>$0 if you\u2019re married filing separately and lived with your spouse at any time during the tax year.<\/li>\n<\/ul>\n<p>If you\u2019re married and file a joint return, you and your spouse must combine your incomes and Social Security benefits when figuring the taxable portion of your benefits. Even if your spouse didn\u2019t receive any benefits, you must add your spouse\u2019s income to yours when figuring on a joint return if any of your benefits are taxable.<\/p>\n<p>The Social Security Administration provides a tool\u00a0to help calculate whether Social Security benefits are taxable and if so, how much.<\/p>\n<p>Aside from the higher share of taxable Social Security benefits, beneficiaries will also have to watch their overall income tax bracket, said Jaime Eckels, certified financial planner and Wealth Management Partner with Plante Moran Financial Advisors.<\/p>\n<p>\u201cThe payments could also push individuals into a higher tax bracket or\u00a0IRMMA bracket, affecting Medicare premiums,\u201d she said.<\/p>\n<p>IRMAA stands for\u00a0Income-Related Monthly Adjustment Amount, which is a surcharge added to Medicare Part B and Part D premiums for people with higher incomes.<\/p>\n<h2>Can \u2018No Tax on Restored Benefits Act\u2019 pass?<\/h2>\n<p>Some experts said they doubt the bill to amend the tax code would pass.<\/p>\n<p>\u201cThe chances that anything passes in this Congress is fairly low, in my opinion,\u201d said Phillip Hulme, owner of Stars &amp; Stripes Financial Advisors. \u201cI think last year set a record for the least amount of legislation passed of any class of Congress.\u201d<\/p>\n<p>But also, never say never.<\/p>\n<p>\u201cMaybe this is one of the few things they (politicians) can use to rally some support for themselves,\u201d he said. \u201cAfter all, who doesn\u2019t like free money?\u201d<\/p>\n<h2>Can beneficiaries lower their taxes?<\/h2>\n<p>People have a few options they can try to avoid more taxes. They include, experts say:<\/p>\n<ul>\n<li>If the lump-sum retroactive payment pushes your combined income above the thresholds for the tax on Social Security, the IRS will allow you to\u00a0allocate it to the year you should have received it, Eckels said. You don\u2019t have to \u201camend\u201d your prior year\u2019s tax returns either. Instead, you check the box on line 6c of your\u00a0Form 1040\u00a0or\u00a01040-SR\u00a0if it lowers the taxable portion of your benefits and pay any taxes owed for the prior year with your current year\u2019s tax return.<\/li>\n<li>Contact your local Taxpayer Assistance Center or certified public accountant to get guidance on avoiding increases in Medicare IRMAA. \u201cSince the\u00a0back pay\u00a0is not expected to continue, they could argue that their income is expected to be reduced and that they may qualify for an IRMAA exclusion,\u201d Hulme said. \u201cForm SSA-44 would need to be filed to claim the exception but since this is a novel use case, I can\u2019t say for sure what the IRS will determine.\u201d But it\u2019s worth a try, he said.<\/li>\n<\/ul>\n<p>Medora Lee is a money, markets and personal finance reporter at USA TODAY.
